MoodMirror AI Terms of Use

Welcome to MoodMirror AI (“MoodMirror,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of the MoodMirror AI mobile application, website, and related services (collectively, the “Service”).
By accessing or using the Service, you agree to these Terms. If you do not agree with these Terms, please do not use the Service.
If you use MoodMirror through the Apple App Store, your use of the application is also subject to the applicable terms and conditions of Apple and the App Store. Nothing in these Terms is intended to modify or override any rights or obligations that cannot be modified under applicable law or Apple's applicable agreements.
1. About MoodMirror AI
MoodMirror AI is an emotional journaling and self-reflection tool that uses drawing, drawing behavior, and artificial intelligence to provide supportive observations and conversational experiences.
The Service may allow you to:
- Create drawings using brushes, colors, shapes, backgrounds, and other drawing tools;
- Receive AI-generated observations based on visual elements and drawing behavior;
- Explore reflection indicators such as valence, arousal, stability, and sense of control;
- Have AI-assisted conversations about your drawings or feelings;
- Save and review drawings, analysis results, and conversation history;
- Purchase memberships, subscriptions, AI credits, or other digital features where offered.
The specific features available to you may vary depending on your device, account, subscription, purchase, location, and the version of the Service.
2. Eligibility
You may use the Service only if you are legally permitted to enter into these Terms under the laws applicable to you.
If you are under the age required to independently consent to the processing of personal information or enter into a contract in your jurisdiction, you may use the Service only with the involvement and permission of a parent or legal guardian where required by applicable law.
You are responsible for ensuring that your use of the Service complies with all laws and regulations applicable to you.
3. Accounts

To operate and improve the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, process, and otherwise use your User Content only as reasonably necessary to:
- Provide the features you request;
- Perform drawing analysis and AI-assisted conversations;
- Maintain, secure, troubleshoot, and improve the Service;
- Comply with applicable law and enforce these Terms.
Where third-party AI or other service providers are used to provide requested functionality, your User Content may be processed by those providers in accordance with our Privacy Policy and applicable contractual and legal requirements.
4.3 Your Responsibilities
You are responsible for your User Content.
You agree not to use the Service to create, upload, or transmit content that:
- Violates applicable laws or regulations;
- Infringes another person's intellectual property, privacy, or other rights;
- Contains malicious code or attempts to compromise the Service;
- Facilitates fraud, abuse, harassment, or other unlawful activity;
- Attempts to circumvent technical or security restrictions of the Service.
We do not claim ownership of your User Content merely because you use the Service.
5. AI Features and Emotional Reflection
MoodMirror AI uses artificial intelligence to generate observations, summaries, conversations, and other content.
5.1 AI Output Is Not Professional Advice
MoodMirror AI is designed for self-reflection, journaling, and supportive emotional exploration.
The Service does not provide:
- Medical diagnosis;
- Psychological diagnosis;
- Mental health treatment;
- Professional counseling or therapy;
- Medical advice;
- Emergency response services.
AI-generated observations are not a clinical assessment and should not be treated as a diagnosis or professional opinion.
5.2 AI Output May Be Inaccurate
AI-generated content may be incomplete, incorrect, inconsistent, or inappropriate for your particular circumstances.
You should use your own judgment when interpreting AI-generated content and should not rely on it as the sole basis for important decisions.
5.3 No Emergency Service
MoodMirror AI is not an emergency service and is not designed to respond to urgent or crisis situations.
If you believe you or another person is in immediate danger, or if you are experiencing a mental health emergency, contact your local emergency service or an appropriately qualified professional.
6. Memberships, Subscriptions, and AI Credits
MoodMirror may offer paid memberships, auto-renewable subscriptions, AI analysis packages, credits, or other digital features.
The availability, pricing, benefits, and limits of these offerings will be displayed at the time of purchase.
6.1 Apple App Store Purchases
For purchases made through the Apple App Store, payment is processed by Apple through Apple's In-App Purchase system.
Apple's applicable terms and policies govern the payment processing, billing, subscription management, and refund process for purchases made through the App Store.
We do not directly receive or process your Apple payment credentials.
6.2 Auto-Renewable Subscriptions
If you purchase an auto-renewable subscription through the Apple App Store:
- The subscription provides access to the benefits described at the time of purchase;
- The subscription automatically renews unless canceled in accordance with Apple's applicable subscription rules;
- The applicable subscription price and billing period are displayed before purchase;
- Subscription management is handled through your Apple Account and the applicable App Store settings;
- Cancellation of a subscription generally prevents future renewal but does not necessarily provide a refund for the current subscription period, subject to Apple's applicable refund policies and applicable law.
Subscription benefits may include access to premium features, AI analysis, AI conversations, or other features described in the applicable subscription offer.
6.3 Subscription Changes
We may offer different subscription durations or service levels.
Where supported by Apple, upgrades, downgrades, renewals, and other subscription changes are handled through Apple's subscription system and are subject to Apple's applicable rules.
6.4 AI Credits and Consumable Features
Some features may require AI credits or other consumable usage units.
The number of credits required for a feature, the number of credits included with a membership, and any applicable limits will be displayed in the Service or at the time of purchase.
Unless otherwise stated:
- AI credits are digital usage units for the Service;
- AI credits are not cash and have no monetary value outside the Service;
- AI credits cannot be transferred, exchanged, or redeemed for cash;
- Unused credits may be subject to the terms displayed at the time of purchase.
6.5 Refunds
For purchases made through the Apple App Store, refunds are subject to Apple's applicable refund policies and procedures.
For purchases made through other payment channels, if any, refunds are subject to the terms and policies presented at the time of purchase and any rights provided by applicable law.
Nothing in these Terms excludes or limits any mandatory consumer rights that cannot legally be excluded.
7. Pricing and Availability
Prices, subscription plans, credits, features, and other commercial terms may vary by country, currency, platform, promotional offer, or other applicable factors.
The applicable price and benefits shown to you before purchase will govern that purchase.
We may change pricing or available plans in accordance with applicable law and platform requirements. Where notice or consent is legally required, we will provide the applicable notice or obtain the required consent.
8. Free Trials and Promotional Offers
From time to time, MoodMirror may offer free trials, introductory pricing, promotional subscriptions, bonus credits, or other offers.
Eligibility and duration may vary.
If a free trial or promotional subscription automatically converts into a paid subscription, the applicable conversion terms, price, and renewal conditions will be displayed before or at the time of enrollment, as required by applicable law and platform rules.
You are responsible for canceling a trial or subscription in accordance with the applicable platform's cancellation procedure if you do not wish it to renew.
9. Privacy and Data Processing
Your privacy is important to us.
Our collection, use, storage, disclosure, and processing of personal information are described in our Privacy Policy.
To provide drawing analysis and AI conversation features, relevant information may be processed by our service providers, including third-party AI and cloud service providers.
Depending on the features you use, this may include information such as:

- AI-generated analysis and responses;
- Account and subscription information;

10. Third-Party Services

We do not guarantee that:
- AI-generated content will be accurate or complete;
- Emotional observations will accurately reflect your actual emotional state;
- The Service will meet every user's individual expectations;
- The Service will always be available or uninterrupted;
- Any particular result will be achieved through use of the Service.
MoodMirror AI is a self-reflection and journaling tool and is not a substitute for qualified professional medical, psychological, or mental health services.
Nothing in these Terms excludes any warranty or consumer protection right that cannot legally be excluded.
15. Limitation of Liability
To the maximum extent permitted by applicable law, MoodMirror and its operators, affiliates, service providers, licensors, and personnel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, revenue, or opportunities arising from or related to your use of the Service.
To the extent permitted by applicable law, our total liability arising out of or relating to the Service will be limited to the amount you paid to us for the relevant Service during the period permitted by applicable law.
Nothing in these Terms limits liability that cannot legally be limited or excluded under applicable law.
16. Termination
You may stop using the Service at any time.
If you have an active subscription purchased through the Apple App Store, deleting the App does not necessarily cancel the subscription. You must manage or cancel the subscription through your Apple Account and the applicable App Store subscription settings.
We may suspend or terminate your access to the Service where reasonably necessary to:
- Prevent fraud or abuse;
- Protect the security of the Service or other users;
- Enforce these Terms;
- Comply with applicable law;
- Discontinue a Service or feature.
Termination does not affect rights or obligations that by their nature should survive termination.
17. Apple-Specific Terms
If you downloaded MoodMirror AI from the Apple App Store, the following additional terms apply:
- These Terms are between you and MoodMirror, not Apple.
- Apple is not responsible for the Service or its content.
- Apple has no obligation to provide maintenance or support services for the Service.
- To the extent required by applicable law, Apple has no obligation to provide warranty services for the Service.
- Apple is not responsible for addressing claims relating to the Service.
- Apple is a third-party beneficiary of these Terms and may enforce these Terms against you where applicable.
- Your use of the Service must comply with the applicable App Store Terms and Conditions.
For the avoidance of doubt, where the Apple App Store provides its own rules concerning payment processing, subscriptions, billing, cancellation, refunds, or other App Store functions, those Apple rules apply to the relevant App Store transaction.
18. Relationship with Apple's Standard EULA
If we have not provided a custom EULA to Apple for the applicable version of the application, your use of the licensed application may also be subject to Apple's Standard Licensed Application End User License Agreement (EULA).

These Terms govern your relationship with MoodMirror regarding the Service, while Apple's applicable terms govern matters relating to the Apple App Store and Apple's platform services.
In the event of a conflict concerning an Apple platform matter, the applicable Apple terms and requirements will control to the extent required by Apple or applicable law.
19. Updates to These Terms
We may update these Terms from time to time.
When we make material changes, we may provide notice through the Service, our website, or other reasonable means where required by applicable law.
The updated Terms will become effective when posted or on the effective date stated in the updated Terms.
Your continued use of the Service after the effective date means that you accept the updated Terms to the extent permitted by applicable law.
20. Governing Law and Consumer Rights
These Terms are governed by the laws applicable to the relationship between you and us, except to the extent that mandatory consumer protection laws in your jurisdiction provide otherwise.
Nothing in these Terms is intended to deprive you of mandatory rights or protections available to you under the laws of the country or region where you reside.
Where applicable law grants you the right to bring a claim in a particular jurisdiction or forum, nothing in these Terms prevents you from exercising that right.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by applicable law.
